Application and Consumer Protection

These General Terms and Conditions (the "Terms") apply to the purchase agreement that you as a consumer enter into with Mountain Tales Design AB, corporate identity number 559285-0126, hereinafter referred to as "Mountain Tales". To safeguard your interests as a customer, the provisions of the Consumer Purchase Act (SFS 1990: 932), the Distance and Home Sales Act (SFS 2005: 59) and the Data Protection Ordinance (GDPR) apply to all purchases at www.mountaintalesdesign.com

 

Personal information

Read more about our processing of personal data in our Privacy Policy. In connection with your order, you agree that we store and use your information in our business to complete and provide the service that you can expect from us. All personal data processing takes place in accordance with the Data Protection Ordinance. The person responsible for personal data is Mountain Tales Design AB (corp. No. 559285-0126). Mountain Tales’ customer register contains personal information such as name, social security number, postal address, telephone number, e-mail address and IP number. The purpose of Mountain Tales’ processing of collected personal data is to use these to:

a. Be able to complete purchases at Mountain Tales

b. Enable targeted marketing via email, text message and other channels based on your previous purchases or use of Mountain Tales’ channels.

Klarna will collect personal information about you in connection with payment. Klarna is thus responsible for personal data for such personal data in accordance with Klarna's terms

Mountain Tales will share the personal information to the shipping companies required to be able to complete and deliver an order.

When you as a customer choose to e-mail to Mountain Tales, your e-mail address and e-mail history will be saved to make it possible and easier to follow up and respond to a case.

No information will be resold to third parties or forwarded to third countries.

General information about the processing of personal data

All processing of personal data takes place in accordance with the Data Protection Regulation (GDPR). The person responsible for the treatment is Mountain Tales.

We only store personal data for as long as necessary, after which they are deleted. If information is incomplete, incorrect or irrelevant, you have the right to request that it be corrected or deleted. You also have the right to claim damages if the processing of your personal data has not complied with the law.

Prices and Fees

The prices stated on www.mountaintalesdesign.com are stated including VAT (VAT). Shipping terms differ per delivery country and the most updated information can be found under ‘Shipping & Deliveries’.

Establishment of a purchase agreement

Mountain Tales’ goods are ordered at www.mountaintalesdesign.com or via our customer service. A purchase agreement is established when your order has been confirmed by Mountain Tales via e-mail to the e-mail address you specified when ordering. By ordering, you accept these Terms. Mountain Tales does not enter into agreements with minors (under the age of 18) without the parent's approval. At www.mountaintalesdesign.com, agreements can only be entered into with customers with a delivery address.

 

Delivery

Normal delivery time is 2 - 7 working days from the order date.


In connection with your order being sent from Mountain Tales’ warehouse, an email will be sent to the specified email address. The package should then reach you within 2-7 working days depending on the delivery country. If you have not received your delivery within 7 working days, we ask you to contact customer service.

Mountain Tales use several different service providers to ship customer orders. Visit ‘Shipping & Deliveries’ to find the latest information about which service provider is used for your market. When a package is sent out - a tracking email will be shared to follow the shipment. When collecting a consignment, a valid ID document must normally be presented.


Unredeemed Packages / Shipments

Packages that have not been picked up within (7) days will be returned to Mountain Tales. If this happens, you will be charged a fee for costs attributable to Mountain Tales’ administration, shipping, return shipping and handling. Unredeemed packages are not covered by the right of withdrawal.

 

Right of withdrawal / return

As a consumer, you always have a fourteen (14) day right of withdrawal according to the Act on Distance Contracts and Contracts Outside Business Premises (2005: 59). To make you feel completely safe with your purchase, Mountain Tales’ instead offers a sixty (60) day right of withdrawal from the time you receive the product or a significant part of it.

If you want to return your item for exchange or repurchase during this time, please contact us to initiate the return process and to obtain a return slip. If you choose to return your item with the enclosed return slip, Mountain Tales's may charge you according to the information under ‘Shipping & Deliveries’, which will be deducted from the item's value in connection with a refund. If you choose to send the product in another way, you are responsible for the cost. Returns cannot be sent against Cash on Delivery / Cash on Delivery.

Upon receipt and approval of the return, the refund will be made within fourteen (14) days of Mountain Tales receiving the return. Repayment is only made by deposit to a bank account, not cash. Costs for services linked to delivery such as express pack and postal advance fee are not reimbursed upon return.

You as a customer obviously have the right to try and examine the product at home to ensure that the product meets your expectations. If you return an unused item with associated labels and packaging within 60 days, the full amount will be refunded, or the desired change will be made. If the quality of the product has been affected as a result of you as a customer having handled it more than is necessary to investigate its properties or functions, a deduction will be made on the refund corresponding to the depreciation of the product.

When returning, you are at risk for the product, therefore it is important that the product cannot be damaged during transport. In order for a full refund to be carried out, the product must be unused and sent back in undamaged original packaging, all labels must remain and manuals must be sent. It is important that outer packaging is used and that tape or other material is not pasted on the original packaging.

To enable a possible return, you need to be able to prove the purchase and Mountain Tales recommends that you save the order confirmation and payment reference as a receipt for your purchase.

Complaint

If an item deviates from what follows from the agreement between you and Mountain Tales or otherwise does not correspond to the description of the item that Mountain Tales has provided, the item can be returned. Only original defects are covered by the right of complaint, the right of complaint does not include defects caused by normal wear and tear. Complaints to Mountain Tales must be made within a reasonable time after the error is discovered, but no later than within 6 months. Mountain Tales reserves the right to remedy the defect in the first instance, in the second instance re-delivery of the goods and ultimately repurchase. In the event of a complaint, use the enclosed return slip (if you have lost it, contact customer service and we will send a new one). Mountain Tales has no possibility to reimburse the cost of return shipping afterwards.

 

Return of promotional items

For purchases that entitle to a gift or extra discount, the value of the gift or the extra discount is considered a general discount on the entire amount at the time of purchase. If any part of the purchase is exchanged and / or returned, returned goods are valued at the purchase price minus their relative share of the general discount. In the case of exchanges, there is no recalculation of the original basis for a gift or discount.

A promotion or offer of such a gift or extra discount is only available for new purchases via the site www.mountaintalesdesign.com and cannot be obtained retroactively. Gift or discount cannot be transferred to another purchase and cannot be credited when exchanging for another item.

 

Transport damage

Mountain Tales is responsible for goods that are damaged or lost during delivery to you. Complaints about transport damage must be made within a reasonable time. When receiving the shipment, it is therefore important to check that the goods are not damaged during transport. Mountain Tales recommends that you report any transport damage directly on site to the delivery agent and then contact Mountain Tales’ customer service. Remember to keep all packaging and product packaging in the event of a transport damage.

 

Payment

In collaboration with Klarna, we offer invoice payment, partial payment, credit card payment and direct payment. This payment solution is called Klarna Checkout.

By leaving information at the checkout, you accept Klarna's terms. By clicking on "Complete purchase", you accept Mountain Tales’ general terms.

Klarna Checkout presents certain information to you as soon as you are identified. The information you need to enter to achieve identification may vary between different purchases and customers. No credit information is ever taken directly in Klarna Checkout, but if necessary, depending on the payment option you have chosen. Credit information taken by Klarna does not affect your creditworthiness and cannot be seen by others who request credit information about you, such as banks. After you have been identified, Klarna Checkout shows which options are available to you. Invoice is pre-selected as a payment option, but you can of course freely choose one of the other options, such as direct payment via bank or payment by card. The options you are offered may vary from time to time. You can choose whether you want to protect your use of Klarna Checkout with a PIN code.

 

Force majeure

In the event of circumstances beyond Mountain Tales’ reasonable control, such as in the event of a change in legislation, government action, strike, blockade, sabotage, war, terrorism, fire, flood, natural disaster or similar events, Mountain Tales’s obligation to fulfill the purchase agreement shall be suspended for as long as the circumstances prevail. If such delay exceeds 2 months, both you and Mountain Tales have the right to terminate the agreement with immediate effect without any obligation to pay damages.

 

Price and Product Information

In the event of any errors in stock status or price, Mountain Tales reserves the right to terminate the purchase agreement. If the product has expired or for some other reason is not available, Mountain Tales is not obliged to provide the product but can suggest an alternative product. All image information should be considered as illustrations and cannot be guaranteed to reflect the exact appearance and nature of the product.

 

Reviews

By submitting reviews about products on www.mountaintalesdesign.com, you also give Mountain Tales the right to publish them on www.mountaintalesdesign.com and in other channels and media. Mountain Tales reserves the right not to publish and / or delete submitted reviews.

 

Other

We follow the General Complaints Board's recommendations and Swedish law in the event of a dispute. Any dispute must be resolved by either the General Complaints Board (ARN) in Sweden or the European Commission Online Dispute Resolution (EU ODR).
